Hello,
for our new construction project, we would like to build a double garage or a double carport with a storage shed that has direct access to the house.
How is this regulated in Lower Saxony? A 6x9m (20x30 feet) boundary construction is allowed without the neighbor’s approval, right?
However, I think I heard that a maximum of 36 square meters (387 square feet) of usable area is permitted, and with 6x9m (20x30 feet), that would be clearly too much.
So what is correct?

How does it work if the neighbor agrees? Can I then build a carport on the second boundary as well? If so, probably only with a building encumbrance registered on the neighbor’s property.

§ 5 (8) sentence 3 Lower Saxony Building Code:
"Structures according to sentence 2 may reduce the distance according to paragraph 2 along a total length of 9 m per property boundary, but only along a total length of 15 m on the entire building plot."
And how does it work if you want to build a carport 1 meter (3 feet) from the boundary? Is that even allowed, or is it prohibited due to the 3-meter (10 feet) building setback? The idea is to be able to access the back wall later for painting or similar work without having to cross the neighbor's property.
Boundary construction includes everything within the standard setback distance, which is usually 3.0 meters (10 feet). Whether the garage is built directly on the boundary line or set back by 2 meters (6.5 feet) does not matter; both are considered boundary construction and fall under the 15-meter (49 feet) regulation. However, there are now efforts to reduce the required setback distances in residential areas, for example to 2.5 meters (8 feet) or even 2 meters (6.5 feet). With individual permits or neighbor consent, it is also possible to build even closer.
In principle, a carport can also be constructed with some distance from the boundary if you need access for painting. However, this is usually unnecessary because maintenance or repairs can be carried out from the neighbor’s property if there is no other way. In such cases, you need to notify the neighbor, but this should generally be manageable in a normal neighborly relationship.
