ᐅ Boundary Construction of a Double Garage/Carport 6x9m in Lower Saxony

Hello,

for our new construction project, we would like to build a double garage or a double carport with a storage shed that has direct access to the house.

How is this regulated in Lower Saxony? A 6x9m (20x30 feet) boundary construction is allowed without the neighbor’s approval, right?

However, I think I heard that a maximum of 36 square meters (387 square feet) of usable area is permitted, and with 6x9m (20x30 feet), that would be clearly too much.

So what is correct?

I didn’t want to create a new thread just for this and hope someone can help me here.
I would like to know if I am allowed to attach a carport (5m x 6m) directly in front of my double garage (6m x 9m), which is positioned with its 9m side along the property line. The carport’s 5m side would also be right on the property boundary (in Lower Saxony).

Check the Lower Saxony State Building Code (NDS Landesbauordnung); I think there is a 12-meter (39 feet) rule for all buildings on the boundary line combined.
Also, with a carport, the floor area ratio must not be exceeded.

thank you for your reply. If I understand the Lower Saxony Building Code correctly, I am not allowed to build a carport in front of or behind my garage, as it is already 9 meters long (30 feet). However, I assume I may be allowed to build a carport up to 6 meters (20 feet) long on another boundary line, making a total of 15 meters (49 feet). Is that correct? Or is it possible to apply for a building permit / planning permission to build the full 15 meters (49 feet) on one boundary, provided that there is no structure on any other boundary? Phew, this is really complicated...

§ 5 para. 8 Lower Saxony Building Code: Setback Distances

(8) No setback is required

1. Retaining walls, embankments, and enclosures in commercial and

industrial zones, outside these building zones, up to a height of

2 meters (6.5 feet), and

2. Buildings and enclosures in building zones where, according to the

development plan, only buildings with a garden courtyard enclosed

from external view are permitted, provided they do not exceed 3.5 meters (11.5 feet) in height.

Without setback or with a reduced setback of at least 1 meter (3 feet)

from the boundary are permitted

1. Garages and buildings without habitable rooms or fireplaces up to

3 meters (10 feet) in height, and

2. Solar installations that are not part of a building, up to 3 meters (10 feet)

in height.

Buildings according to sentence 2 may reduce the setback according to

paragraph 2 along a total length of 9 meters (30 feet) per property boundary,

but on a building plot, this reduction may only extend along one boundary

for a total length of 15 meters (49 feet). When applying sentences 2 and 3,

buildings built on the boundary without setback as described in sentence 2,

item 1, must be taken into account according to paragraph 5 sentence 2. When

applying sentence 1 item 2, paragraph 2 sentence 3 applies accordingly.

Yes, sorry, I could have given you this answer spontaneously as well (maximum 9 meters (30 feet) on one side), but I was a bit confused by the previous post.
9 meters (30 feet)!
A carport is included.

No, but it might be possible with a signed agreement from the neighbor... they have to give written consent.
