I discovered your lovely forum thanks to Google. Unfortunately, as is often the case, a problem has brought me here.
We are building an extension onto an existing semi-detached house in Baden-Württemberg.
We are building on a slab foundation. The friendly neighbor built his half with a basement.
We live 70 kilometers (about 43 miles) away from the construction site.
Therefore, with both of us working and having two children, we cannot be at the site all the time.
Yesterday morning, the workers began setting the formwork for the slab foundation.
When I arrived at the site yesterday, my friendly neighbor was already there waiting for me.
He yelled at me quite loudly and was extremely angry.
He said that the slab foundation towards his side was insulated only with Styrodur (extruded polystyrene).
One of the workers tried to explain that in addition to the Styrodur, a 4 cm (1.6 inch) soundproofing wall would be installed along the house.
Still, he did not calm down.
He just kept yelling. He said he would take pictures and that he would refuse to pay.
We have no intention of demanding any money from him.
I was really shocked!!!
Actually, he should be worried, since he built 3 cm (1.2 inches) of his house’s total length over our property boundary.
What is the legal situation here?
I told my husband about it.
He wanted to see a lawyer right away.
For me, maintaining peace with the neighbor is more important.
Please excuse my spelling mistakes and my lack of knowledge. I have two children and need to keep them happy at the same time.

@kbt09 You don’t have children, right? Just curious at the moment.
Our former neighbor had two dogs, and they never bothered us. Their dogs were very well-behaved, and children can be like that too. So why on earth would someone immediately want to sell their house because of that?!
As a child, I would find it very sad if neighbors sold their homes because of me. If I live in a central area, as an owner I have to expect that families might move in next door. Otherwise, you’d have to move into the woods, where it’s usually quiet.

Those sensitive to noise shouldn’t be accused of hating people when they change their environment because it’s too loud.Don’t you get it? Again, who said that children make the surroundings more chaotic?! In my childhood, I can’t remember a single time neighbors complained about my so-called loudness.
You know what’s strange? People who talk like that usually don’t have children, it’s a recurring pattern.
The behavior you see as normal, I see as inconsiderate. You generalize and don’t even give families a chance!!
And again, if families ignore everything, I can fully understand why neighbors decide to move away!!!!!!

Families don’t really care whether a neighbor sells their house or not! In most cases, another family with children moves in – and the children will probably get more use out of it than a retired couple.
Besides, many people would actually be happy about retirees selling their homes – more houses on the market for families.

Here in Germany, you are often seen as an annoyed person with kids—with my (well-behaved) three children, you often get strange looks (in hardware stores, restaurants, hotels, etc.). Terrible! Exactly. Once you have two children, you’re already considered antisocial and lazy. Because you’re only after child benefits and tax advantages, and one parent wants to stay home out of laziness. And then there’s the noise! Just yesterday, we were confronted about making noise. It’s the weekend, so could we be quieter? No, we can’t! Children are not worn out, plus COVID and all that! They should complain to Merkel! Normally we would be at the zoo, water park, etc., but none of that is possible at the moment.
