Hello dear members,
I discovered your lovely forum thanks to Google. Unfortunately, as is often the case, a problem has brought me here.
We are building an extension onto an existing semi-detached house in Baden-Württemberg.
We are building on a slab foundation. The friendly neighbor built his half with a basement.
We live 70 kilometers (about 43 miles) away from the construction site.
Therefore, with both of us working and having two children, we cannot be at the site all the time.
Yesterday morning, the workers began setting the formwork for the slab foundation.
When I arrived at the site yesterday, my friendly neighbor was already there waiting for me.
He yelled at me quite loudly and was extremely angry.
He said that the slab foundation towards his side was insulated only with Styrodur (extruded polystyrene).
One of the workers tried to explain that in addition to the Styrodur, a 4 cm (1.6 inch) soundproofing wall would be installed along the house.
Still, he did not calm down.
He just kept yelling. He said he would take pictures and that he would refuse to pay.
We have no intention of demanding any money from him.
I was really shocked!!!
Actually, he should be worried, since he built 3 cm (1.2 inches) of his house’s total length over our property boundary.
What is the legal situation here?
I told my husband about it.
He wanted to see a lawyer right away.
For me, maintaining peace with the neighbor is more important.
Please excuse my spelling mistakes and my lack of knowledge. I have two children and need to keep them happy at the same time.
Thank you,
Sandra

Reading all of this, I can increasingly understand @Steven.

But apparently, I’m not alone with my problem. Well, I know for sure I wouldn’t want any of “us” as neighbors here.
One has paranoia, another always thinks they’re right, the next doesn’t want neighbors—so not me—another has 4 unruly kids, one turns into the neighbor policeman, another will probably check the property line at night, then there’s the one you can’t get rid of, the snob, and the quarrelsome one ...

You can call me naive if you want, but I don't care what they do, and I have never even glanced at what they are building on their property; it simply doesn’t interest me. Please don’t misunderstand me either, I respect this attitude and find it very likable, but because of it, the following here:

But then they should leave us alone as well. may not be achievable. Some people are just not like that. What’s ironic here is:

By the way, the survey marker from our surveyor is no longer there, but a real boundary stone has appeared. Next to the gardener’s paved area. Whether it has always been there, no idea, because there used to be a layer of gravel several centimeters (inches) deep. Whether it wore down over the years, no idea. Boundary stones may shift over time, but property boundaries do not. If the survey was done correctly, your survey counts, regardless of where a stone appears. So, without seeking a discussion, a clear message is being sent. This is not mature. So much for what other people conclude from your attitude, which I find sympathetic…

One is paranoid, another always insists they’re right, the next doesn’t want neighbors at all—not me, of course—then there’s the one with 4 unruly kids, another acts like the neighborhood watch cop, someone else will probably check the property boundary at night, there’s the one you just can’t get rid of, then the snob and the troublemaker...
(and that one can easily be swapped with the other) You can go ahead and mention the names here... come on, be brave!

You tend to stick to your opinion and, I believe, are then quite resistant to other perspectives.
I don’t mean this in a negative way!!!
There were really some funny moments too.
I thought it was great that you contributed here, despite the opposition.
There have been really nice and factual posts here.
Above all, it has been good for my peace of mind!
I have also looked around other areas (here in the forum).
It’s surprising what kind of people are active here!!!!

the next one doesn’t want neighbors, so not me, Hello ypg
This thread is already quite long, so in my opinion, it can still wander a bit further.
I want neighbors and I have them. A whole village full. We have 42 houses and one and a half streets (I built half of one). My neighbors (except for one) are lovely people. Ones you can spontaneously have a beer with while gardening. Or chat with at village festivals. And have a few more beers. The one neighbor, whom I call "my Floddars," has been quiet for a year now. Lost his driver’s license (drunk driving [once he nearly hit me with almost 2‰ blood alcohol]), often drove unregistered vehicles, drove without a license, fraud, etc. Just small-time criminal. Got 16 months probation. Didn’t care. Then he skipped bail. Three days of coercive detention. Now he’s behaving. I’ve only learned about his scams from creditors who sometimes come knocking asking for him.
Otherwise, great neighbors. Also with kids. I contribute financially to children’s events, St. Martin’s Day, and other occasions.
My plot (1,000m² (11,000 sq ft)) faces south. Behind it there are 6,000m² (65,000 sq ft) of garden land. “My” street is a farm access road, which I paved, that leads there. And I’m worried that a clever investor will buy the land, use their connections, and build several apartment buildings there. Behind that is a stream.
That’s why, to protect my view, I want to buy the garden land.
