Hello,

we have been living in the new house for a few weeks now, and from time to time, I notice things that make me want to ask questions. Like these two:

1. Throughout the house, the windows are generally wooden and have a consistent color and style. However, there is a difference on the top floor: there is only one window that matches the rest of the design on the ground floor and first floor. Another window and a door leading to the roof terrace look completely different.

2. Apart from the two windows mentioned above, all window handles in the house are identical. Yet here, too, there are two windows with different handles installed.

Is this normal? Is it allowed to have such different fittings in a newly built house?

On the top floor, there is a seating area, and otherwise, it serves as the transition to the roof terrace.

And is the roof structure including the gables/dormers constructed the same way as the rest of the house?

I don’t understand. You access the attic via an open staircase (also open) and there you have about 6sqm (65 sqft) seating area with a window in standard design, and from there a door with a different design leads to the roof terrace.

The Higher Regional Court of Düsseldorf ruled under case number I-21 U 23/14 that a contractor cannot generally refuse to remedy a defect if it is only a cosmetic issue. According to the ruling, the contractor must fix the defect, even if it only affects the appearance. It would be different if you yourself have little interest in having the defect remedied and/or if the effort required is disproportionately high.

Perhaps you could communicate this to the developer. However, before involving a lawyer, I would recommend trying mediation first. Chambers of crafts / trade associations are often willing to assist with this as well.
