seat88Hello, we live in beautiful Saxony. Here, if you place a carport on the property boundary, you don’t need a building permit / planning permission as long as you follow a few general rules.
Among other things, I am restricted to a height of 3 meters (10 feet). Now my question is: where is this height measured from? Our property is raised by about 40 centimeters (16 inches) compared to the neighbor’s. Since I need a clear driveway height of 2.40 meters (7 feet 10 inches), plus about 30 centimeters (12 inches) for the roof structure, I end up at 2.70 meters (8 feet 10 inches). So far, so good. But if the neighbor measures with their tape measure, they would get 3.10 meters (10 feet 2 inches), which is too high. How is this handled? After all, the carport is on my property, so shouldn’t only the height on my side be decisive? I just don’t want to make a mistake and have to shorten the carport’s height in the worst case.

Yes, but it is not documented anywhere; I can only see it at the neighbor's property....However, he could refer to that. The 3 meters (in the state building code) or the setback rules and height restrictions are there to protect others, so arbitrary decisions are not allowed. The height, however, relates to the boundary development. Do you have the option to build with a setback?

You could also call Mr. Müller at the building authority, explain that you want to build a carport without requiring a permit, and describe the situation.
Plan C: would a shed roof be an option, meaning the slope towards the neighbor? If so, make sure to pay attention to drainage.
