ᐅ Appointment postponed due to incorrect window color

Hello,

After a lot of back and forth, we finally got a scheduled date for our house on November 25, 2020. At the beginning of September, we took the foundation slab out of the scope of our prefab house manufacturer and completed it ourselves so that the house could still be erected this year.

Then today we received a call from our house manufacturer saying that the window company delivered the windows incorrectly (exterior color inside and interior color outside). The installation date has been postponed indefinitely.

I understand that there is nothing we can do to have the house delivered this year, but are we entitled to any compensation? Should we get in touch with a lawyer?

In that case, I’d say tough luck. Your builder will probably try to wiggle out of the foundation slab issue since it involves subcontractors. If you want to put pressure on the builder, you could notify them that you reserve the right to charge any additional costs incurred. However, you would need to provide solid evidence for these costs. Keep in mind, this approach could also negatively affect your business relationship.

What are the two window colors? This might be a silly question, but maybe there could be an interesting approach along these lines...

And then there is the fact that you removed the foundation slab from the contract. So the timing of "8 weeks after the foundation slab" is no longer defined.

Two questions for the supplier:
1. When will the house be erected?
2. How do you ensure that the agreed handover date can be met?
