Does the 3m (10 feet) minimum distance apply from the foundation slab? I would like to make the foundation slab 10cm (4 inches) larger and add facing bricks afterwards, while maintaining a 3m (10 feet) distance from the building wall, and later reduce the distance to 2.90m (9.5 feet) with the brick facing according to clause 14 of the NRW building regulations. Is it possible that the 10cm (4 inches) overhang of the foundation slab does not count towards the property boundary? Regards, Simon

I have not encountered such a case before, but intuitively I would say that this is only possible with a setback of the building (which is counterproductive) or an easement granted by the neighbor. Maybe Dirk can provide more reliable information here.

This is to allow for the foundation needed later for the brick facing. That's why I’m asking whether the foundation can already be extended during the house construction, independently of the 3-meter (10 feet) rule. After all, it’s not living space, less than 3 meters (10 feet), less than 2 meters (6.5 feet). Then the brick facing would be added about six months after the house is finished. According to this paragraph, that should be possible, but I don’t want to take any risks.

Improving thermal insulation? So, you are planning and building a house compliant with the Energy Saving Ordinance (monolithic or with ETICS?) and want to promote the brickwork afterwards as a thermal insulation measure?

Yes, with ETICS, that’s exactly what I would like to do. The question is how realistic that is.
