as the title suggests, I wanted to first ask here what applies to my case 😉
Here is the situation: Please see the sketch.
Between the house and the property line, about 6 m (20 ft) away, a storage room 5 m (16 ft) wide is planned, matching the depth of the house (with a 1 m (3 ft) gap to the neighbor). In front of it, a carport measuring 6 x 6 m (20 x 20 ft), also with a 1 m (3 ft) gap to the neighbor, will be attached.
All of this is to be built using timber frame construction with a 7% slope and a continuous parapet.
Due to the elevation of the site, the foundation slab had to be raised 60 cm (24 inches) above ground level.
Now to the question:
If the maximum allowed height to the top edge of the roof is 3 m (10 ft), the resulting interior room height would be about 177 cm (5 ft 10 in), which is somewhat unsatisfactory. Before bothering the neighbor and the building authority/planning office, is it possible to deviate from the maximum height? A raise of 60 cm (24 inches) would be sufficient, giving a room height of 237 cm (7 ft 9 in).

In Lower Saxony, it is also regulated that nothing within the 3-meter (10 feet) limit may be higher than 3 meters (10 feet). This means, for example, that the roof can start at 3.5 meters (11.5 feet) at a distance of 6 meters (20 feet) and then must be no higher than 3 meters (10 feet) at the 3-meter (10 feet) boundary.
The sketched lower roof line is therefore already correct. You would need to adjust the slope differently if you want more headroom on the left side.
The question is whether you need a building permit / planning permission for the carport in Saxony-Anhalt.

the brown horizontal beam with a slope represents my desired height and has an average interior height of 2.50m (8.2 feet) and, including the roof structure, 3.60m (11.8 feet) with exactly 3m (9.8 feet) distance from the property boundary.
The dashed horizontal beam corresponds to the permitted overall height of 3m (9.8 feet), but this leaves only a room height of 1.77m (5.8 feet) at the end. The storage room with carport has a total depth of approximately 15m (49.2 feet) running parallel to the boundary line (1m (3.3 feet) distance). This was also submitted and approved with the building permit / planning permission application, including neighbors’ signatures. The subsequent height increase was only determined shortly before groundworks, during the on-site meeting.
The question is whether it is possible to slightly deviate from this with approval from the building authority and neighbors, or if that is impossible from the outset?

tdiedition26 Aug 2016 11:39Further plans? The heights are already specified, or are you suggesting there might be a higher point on the property?
Is a deviation from the 3m (10 feet) height limit even possible if all parties agree?

What you provided is a cross-section. If you want me to give you any feedback, I would need site plans and information on the ground elevations. Even then, it wouldn’t help much, so you should ask your architect or authorized building professional.
