ᐅ Semi-detached house – Troubles with the neighbor

Hello dear members,

I discovered your lovely forum thanks to Google. Unfortunately, as is often the case, a problem has brought me here.

We are building an extension onto an existing semi-detached house in Baden-Württemberg.
We are building on a slab foundation. The friendly neighbor built his half with a basement.
We live 70 kilometers (about 43 miles) away from the construction site.
Therefore, with both of us working and having two children, we cannot be at the site all the time.
Yesterday morning, the workers began setting the formwork for the slab foundation.
When I arrived at the site yesterday, my friendly neighbor was already there waiting for me.
He yelled at me quite loudly and was extremely angry.
He said that the slab foundation towards his side was insulated only with Styrodur (extruded polystyrene).
One of the workers tried to explain that in addition to the Styrodur, a 4 cm (1.6 inch) soundproofing wall would be installed along the house.
Still, he did not calm down.
He just kept yelling. He said he would take pictures and that he would refuse to pay.

We have no intention of demanding any money from him.
I was really shocked!!!

Actually, he should be worried, since he built 3 cm (1.2 inches) of his house’s total length over our property boundary.

What is the legal situation here?
I told my husband about it.
He wanted to see a lawyer right away.
For me, maintaining peace with the neighbor is more important.

Please excuse my spelling mistakes and my lack of knowledge. I have two children and need to keep them happy at the same time.

I admittedly skipped the last 10 pages, but I can say that I would really enjoy hanging out with some of you at the garden table and pondering about life and the world late into the night.
I love discussing things. Unfortunately, many others don’t. But there are a few like-minded people here.
I love it!

There are some interesting characters here...

You ask someone: How are you doing?
They go into great detail, talking about human psychology and physiology, writing as complexly as possible.

But at least they understand humor, and that’s good!!

And that can be a lot of fun. For example, my father-in-law is incredibly well-read. We don’t always agree on many things, but we can discuss until late at night. Then we toast with another glass of red wine and laugh...

What is this about again?
I’ve just skimmed through the last 40 pages and I’m wondering what I’m supposed to do with all this now?!?

Ah well, I’ll just go for a run now, that will probably relax me more.

Oh, I haven’t mentioned the blackberries yet, so here it comes^^: You really should plant them either with a very good root barrier or far away from your neighbors, because they spread a lot over the years and can reappear many meters away underground—same goes for raspberries. Last year, we planted six raspberry bushes right at the property boundary, but installing the root barrier there was a huge effort… I think about 60cm (24 inches) deep. Elsewhere in the garden, there are two raspberry bushes left by the previous owner without any barrier, and they keep popping up within about 4 meters (13 feet) around the area (we just keep mowing them down repeatedly).
