Does anyone know the details of how the "previous year period" for the 80% maximum limit is determined for new constructions where no data from the "previous year period" is available? Please also provide a source if possible.

It isn’t determined at all. The gas price cap does not apply to new buildings. Probably no one considered that there might be new buildings using gas—since green policies are strongly pushing heat pumps.

This is the only statement I found:

Heating cost 9.5 cents/kWh; annual consumption forecast forms the basis of the September 2022 advance payment.

It’s good that it’s based on the annual consumption forecast. In our case, it’s always 25% higher than the actual consumption, so we never have to pay extra 🙂

Do you also get the impression that the gas and electricity price caps are being heavily exploited by the suppliers for windfall gains? Gas prices on the markets seem to have been decreasing for quite some time, but here in the Leipzig district, postal code 0457x, we now have to pay higher gas prices starting 01/01/23:

Electricity consumption price: previously gross 27.78 --> from 01/01/23 gross 48.06
Gas consumption price: previously gross 12.65 --> from 01/01/23 gross 18.96
(The basic charge remains the same with both suppliers. We do not have a special contract but are still on standard and backup supply for now.)

It’s really unfortunate for us that our electricity forecast was so low; the hobbies sauna and home brewing have not yet been taken into account by the supplier.

There are definitely some exploitation effects. But you can’t directly pass on stock market prices one-to-one. The providers sign contracts for the future, which is why the default suppliers have been the cheapest for a long time.
This means that consumer gas prices lag behind the exchange prices.
