Zenjamino18 Feb 2022 10:09Hello everyone,
In our building permit / planning permission application, we planned a double garage slightly below street level to stay within the allowed 3 meters (10 feet) of the property boundary building limit. We have now realized that this makes little sense.
We would therefore like to bring the garage up to street level, but then we would exceed the 3 meters (10 feet) limit. We would like to build a carport on the boundary line and next to it, towards the house, a single garage. Here is our current plan:

My question is whether the "roof" of the carport also counts as a reference point, or does the garage roof count instead, since it will be located 3 meters (10 feet) away from the boundary? We mainly want to avoid the double garage, as it really does not look good for the neighbor (who would still approve it).
This is planned in Baden-Württemberg.
Maybe someone can help. Of course, it would be best for me if this stays within the permitted regulations.
Thank you and best regards
Zenjamino

The whole project is planned in Baden-Württemberg. If I remember correctly the assessment of the missing @Escroda, this at least means the advantage that the finished ground level, rather than the original terrain height, is decisive there.

We mainly want to avoid the double garage because it really doesn’t look good to the neighbor (although they would approve it). As far as I know, a carport is treated the same as a garage, so its “wall height” counts (not that of the nearest garage).
If I were your neighbor, I would rather look at a garage wall than at a chaotic mix of kids’ vehicles and trash bins in the carport—at least as long as you don’t raise the height. I would always prefer a rain gutter in front of the gate over turning it into a skyscraper.
