Our family has reserved a plot of land, and we are now considering how to position the townhouse with a carport or garage for one car on the site. The plot is 718 m² (7730 sq ft) and is marked as number 78 in the picture.
The house is planned to have 160-170 m² (1722-1829 sq ft) of living space and two full stories.

What is the best way to position the house? The family consists of two adults and two children (ages 3 and 1).

Oh dear, I wouldn’t want to have to read a development plan in a foreign language.

I don’t see any opportunity to circumvent the rules here – the height levels are sensibly defined for each plot, so that no advantage is given to the valley side.

By the way, slope is more of an ally than an enemy when you want to build an interesting house. I wouldn’t think about leveling the land, and hardly about terracing either.

No, I don't see anything either. Just lots of dormers and a third gable.

Well, in the new development area to the left of your photo section, which belongs to the site plan posted by the original poster, there are a few stepped stories.

Yes, that’s about 6%. You definitely need to consider it carefully and budget for additional costs. With a single garage, a 9m (30 feet) wide house, and a 4.5m (15 feet) wide conservatory, the distance from the access road on the east side would be 16.5m (54 feet), resulting in a height difference of 99cm (39 inches). Not really a major issue.

The original poster already mentioned it. The ground floor is 4.5m (15 feet) larger than the upper floor, which creates a 41m² (441 square feet) roof terrace, so it’s not considered a full additional story. Or alternatively, there’s no roof terrace but a conservatory of similar size (the original poster hasn’t provided any budget details yet).

Maybe someone can explain the reference under C 4 to §2 paragraph 4 of the Lower Saxony Building Code.
(4) Residential buildings are buildings that contain only apartments or rooms serving their ancillary purposes, such as garages.
I suspect there might be an error in the textual regulations, which could at least invalidate this particular provision.
