ᐅ Main Water Line Running Through Our Garden – Is Building Over It Allowed?

Hello everyone,

the main water supply line for our neighborhood runs right through our garden, even though the municipality does not have an easement for it. I have tried to resolve this issue with the local authorities, but I was not offered any reasonable solution.

Am I allowed to plant a tree over the pipeline or build a garden shed on top of it? Does anyone have any experience with this?

Well, a tree can be a bit problematic because of the roots, but a garden shed, why not.

But in theory, it's not my problem if the municipality places a main water line through private land, right? Nothing has been agreed upon in writing.

If there is nothing in writing, you can plant whatever you want there. In the worst case, the utility line breaks exactly at that spot and the municipal utility company steps in. Then the garden will unfortunately be dug up, but it will be properly restored afterwards. Alternatively, a different solution may be sought – for example, repairing the fault by working around the property.

Certainly, all correct. But before the tree causes any damage, it could simply be transplanted two meters (6.5 feet) further away...

Or ask them to remove their stuff from your land.
Is there an alternative access route, or does the utility line route seem unavoidable?
