ᐅ Main Water Line Running Through Our Garden – Is Building Over It Allowed?

Hello everyone,

the main water supply line for our neighborhood runs right through our garden, even though the municipality does not have an easement for it. I have tried to resolve this issue with the local authorities, but I was not offered any reasonable solution.

Am I allowed to plant a tree over the pipeline or build a garden shed on top of it? Does anyone have any experience with this?

Of course, that is complete nonsense. What is above ground is also below ground. So if the crown has or will have a circumference of 20 meters (66 feet), the roots will have that as well (excluding extreme taproot systems).

This is naturally just an approximate guideline to make him aware and suggest he should plant the tree elsewhere. Whether it is two, four, six, or eight meters (7, 13, 20, or 26 feet) should not really matter.
It was an EXAMPLE, but next time I will clarify that better...

Oh, I see.

Everyone here who has to manage with less than 400m² (4,300 sq ft) of land is now trying hard to understand what you mean. ops:

Yes, it comes across differently than you say it – better that way.

We are only hearing part of the story here anyway

Rather less than that. He received the plot as a gift from family. The plot was subdivided for his building project. Some utility lines serve the house, which was cut off from public access by the subdivision. There is a development plan. The new building is finished. The background of the property is as long and complicated as it is — how is anyone supposed to contribute their experience?

I can provide the plan later.

When later?

The municipality or the water supplier must expect that trees could be planted in a garden.

Yes, you can do that. Problems will only arise if work has to be done on the line. Either because you caused damage by planting, or because the supplier won’t take responsibility for your damage (removal of the tree).

Nothing came of it except the offer already mentioned.

I haven’t found any offer. What exactly is the current issue? For planting a tree or setting up a garden shed, you probably don’t need a permit / planning permission. What exactly needs to be clarified with the municipality?

The hole is open and the water pipe is exposed. It is located so far down that I’m no longer really worried about a tree.

My advice is to stay away from the taproot. By the way, how deep is the line approximately?

I would estimate 2m to 2.20m (6.6ft to 7.2ft)
