ᐅ Homeowners’ Protection Association and Expert as a Solution?

Hello everyone,
I'll keep it brief.
We engaged a company to build an extension to our bungalow based on a recommendation from my parents. This company had already completed an extension for them and did a decent job.
However, quite a few things went completely off track with our project. I don’t want to go into the details now. In the end, in autumn 2020, we involved the Building Owners’ Protection Association along with an expert, but even they couldn’t resolve the situation. At the beginning of December, it was agreed with the general contractor for the last time that they should be allowed to fix the defects. A date for this had been set but was postponed indefinitely due to bad weather.

So far, we haven’t heard anything from the contractor. Honestly, we don’t really want to anymore. We just consider it a learning experience and now want some peace. Now to my questions:

We haven’t received a final invoice yet. Will any authority eventually contact us to check if the extension is completed? The land registry office? Or will this just fade away?

Let me summarize what I hope I have understood so far:

3. Now you mention defects and some issues that got out of control, as well as a final invoice that is still missing. From that, we can at least guess that the construction project is somewhere between "started" and "not yet successfully completed" (or "completed but so far from defect-free that it cannot be formally accepted"). Beyond that, we are completely lost like a Martian at a street crossing in Tokyo. Now kindly pull us out of the confusion you have thrown us into and tell us the story of your butcher’s house from the very beginning.

Sorry if I wasn’t clear enough.

This is not about the defects or their remediation—I don’t want to go into those details now. What would that achieve? We unfortunately engaged the wrong company, which advertises turnkey construction. They can do many things well. But there are also many things they can’t do, and then they bring in a subcontractor who is above all cheap and accordingly works that way.

The extension (48 sqm (516 sq ft)) is basically finished, and we are living in it. I mentioned the expert in the first post to make it clear that we really tried everything to complete the project properly.

Unfortunately, when we signed the contract almost two years ago, we trusted too much and signed an agreement that is actually not valid. That’s why the expert advises us against taking any further steps. The contractor just smiles politely and says he tricked us.

The current situation is that the contractor clearly refuses to fix the defects, and we have not received any final invoice from him.

What I really want to know now is: as the client, do I still have any urgent tasks to take care of, or should I just let the whole thing fade away?

Unfortunately, it’s impossible to assess without you telling us what this is all about and what the current situation is. You seem to feel that you’ve been taken advantage of by a company, but unfortunately, you’re keeping the details of how this happened completely to yourself. So, what exactly do you want from us? For us to say “oh dear, poor thing”?

Yes, if you keep beating around the bush before the issue is even clear, THEN it really is (and remains) a nuisance.
But you could also (I know, crazy suggestion) finally EXPLAIN clearly where the problem actually lies. THEN it wouldn’t be pointless complaining, but we could help you, and other readers might benefit as well. But only then.

If you have effectively accepted the new spaces by moving in, you should of course inform the building authority / planning office as well as your household insurance. The construction workers’ compensation insurance will also want to send you a questionnaire.

If you only wanted to know whether you have to report completion in the same way regardless of your satisfaction with the work, just as you would if everything had gone smoothly, you could have left out the whole story about your parents being happy back then and you now feeling cheated by the same company! ! !

Well, strictly speaking, you are not allowed to move into the rooms without a completion notice and approval from the authorities... so yes, you do need to take care of that.
