ᐅ Is a photovoltaic system with storage and additional solar panels mandatory?

We have planned a 10 kWp photovoltaic system with a 4.6 kWp battery storage as a home power solution for an air-to-water heat pump.
Additionally, the consultant offered us a solar system that, according to the Energy Saving Ordinance, would be mandatory for a 40+ house. When we asked if this was correct, we were referred to a specialist for further review, whom we will only meet after signing the contract. This photovoltaic system costs around 3,500 € and we would simply like to exclude it.
Is the consultant’s statement correct that this is mandatory? If not, then it should not be a problem to leave it out.

The storage system doesn’t make economic sense either, but if you want to have something like that, of course you can do it.If at KfW 40+ the only thing missing is the storage system (+5,000 euros subsidy), and you purchase the storage system together with the photovoltaic system (meaning VAT can be deducted; this is not possible with retrofitting), it can almost break even.
