Hello everyone,

I have the following question: we want to raise the ground level of our plot. The building height is fine so far, and the garage is planned to be built right on the boundary. However, there is a green strip with a playground next to it.

Is there any way to increase the 3m (10 feet) garage height? From what I have read, the raising of the ground level on the plot is also included in the height calculation.

Question 2: am I allowed to make the garage roof accessible as a balcony?

The house will be built in Baden-Württemberg.

Does anyone have experience with this?

Probably not, as it would affect the setback requirements. However, you could try contacting the owner of the strip of lawn; maybe the seller would agree to a deal precisely for that reason.

This is debated. In principle, every property boundary is off-limits for construction, and this includes land fill. Check your regional building regulations or planning permission rules; there might be exceptions up to about 1.00 m (3 feet) — I have a similar case currently in NRW.

Only if you maintain a 3.00 m (10 feet) distance from the boundary; otherwise, the balcony would also trigger setback requirements.

Yes, by means of a building obligation (Baulast).

For a "normal" garage height, yes it does; unless the local development plan explicitly states otherwise. However, if the height is increased with the neighbor’s consent, there might be less space left for the accessible part.

The question that arises here is why you are considering building an accessible garage in the first place? You surely have a garden; do you really think you will use the additional terrace, or is this outdoor area intended for a rental unit?

Edit: My information relates to North Rhine-Westphalia (NRW); it may be handled differently in Baden-Württemberg (BW). Your local planner will certainly be able to answer your questions precisely.
