Hello everyone,

I am new here and have a question right away.

But first, a brief introduction.
I am 34 years old, and my wife is 29.
We have a daughter who is 17 months old. We would like to fulfill our dream of owning a home. We live in Düren, district Birkesdorf.

Now to the issue:
I am receiving a plot of land from my father with an area of about 1000 square meters (0.25 acres).
I would like to build there, but according to the development plan and the building authority, only a house with three floors is allowed.

My question is:
Is there possibly a way to build only two floors, or is it simply not permitted? The development plan dates back to 1965.
Because three floors are generally not an option for us.

No, this neighboring house is two stories high, both according to the plan (there is a boundary between two zoning areas running between the properties) and in reality. However, its plot and the adjacent one towards Behring Street fall within the area of the "first amendment" – I’m not sure if the building was constructed before or after that, but it would be interesting to see the details of this amendment. The houses mentioned on Eintracht Street are apparently three stories (though I cannot verify if they belong to the same zoning plan). But as I mentioned, I suspect they obtained a special exemption for the dormers and thus fulfilled the full story height requirement with those dormers.

Isn't only the area marked with the black dashed line included in the first amendment?

Zone might be an exaggeration, but for your lot the city planners clearly planned for a multi-family building. So it could be difficult to get the same exemptions as the neighbors, who obviously exceed the roof pitch with dormers but at least built multi-family houses. The planners probably won’t like your single-family house.

Or the city planning office, since they ultimately have to grant exemptions. Find out why the neighbors were allowed to deviate with roof pitch and roof extensions, and what the prospects for your project are. Without a formal preliminary building inquiry, this is not legally binding, but it should be enough to assess the likelihood of disputes.

Yes.

Since selling is not an option for you and you haven’t given any reasons for your statement "Because three floors are basically not an option," an architect can certainly design a single-family house fully compliant with the development plan for your lot. Of course, it will be far from standard.

Sorry, yes, you're right: the white house is number 7, so it's already outside the amendment.
