we are planning to build a two-story townhouse in Schleswig-Holstein. However, the zoning plan only allows for a single-story building (otherwise, the building height is limited to about 10m (33 feet)). The state building code states:
"A top floor set back from at least one exterior wall of the building or a floor with at least one sloped roof surface counts as a full floor if it has a height of at least 2.30 m (7.5 feet) over at least three quarters of the floor area of the floor below."
If we enlarge the ground floor so that the upper floor has less than 75% of the ground floor’s area, can we then build a townhouse that is considered single-story and has a standard ceiling height of 2.5 m (8.2 feet)?

MelanieSH13 Jan 2019 15:00That’s exactly what one of our neighbors in SH is doing. Only single-story construction is allowed in our area, but he is building a townhouse. This can be achieved with a gallery, balconies, or a recessed upper floor.
We built an extension with a roof terrace on top due to the single-story construction. This extension protrudes around the corner and increases the living room space. Our neighbors solved this with a stepped upper floor, others with a mono-pitched roof. You have many options here.
I am quite familiar with typical SH B plans. If only a single story is allowed, then only bungalows would be possible. Or 1.5 stories? In that case, your version might work. Has anything been mentioned about the roof? It would be typical here to exclude flat roofs and shed roofs, while requiring hip, gable, or pyramid roofs, with roof pitches of 25 degrees or more. However, this would make your project more difficult. Often, the floor area ratio also makes building these “coffee grinders” challenging. Check the text carefully. K.

You are right. For us, WA I plus a maximum height of 9.60 meters (31.5 feet) allows for up to 1.5 stories with a height of 9.6 meters (31.5 feet), and flat roofs are prohibited. A minimum roof pitch of 25 degrees is required. Roof coverings must be clay tiles or concrete roof tiles in red, brown, or anthracite, and not glazed.
