ᐅ Garden Sauna in Bavaria – Distance to Neighboring Property

Hello everyone,

My wife would like to have a small sauna on our property. The land is currently undeveloped, but construction is planned to start in the middle of the year. Now more and more questions and ideas are coming up, including the realization of the sauna 🙂 The sauna should be sized for a maximum of 3 people.

My question is, can/is it allowed to place a small sauna building at the edge of the property near the neighbor? Normally, a 3-meter (10 feet) distance is required between a house and the neighbor’s property line. However, for example, our garage is located directly on the property boundary with the neighbor. Also, is it allowed for the sauna to be built beyond the building limit line according to the local development plan / zoning plan?

However, the definition of a living space seems to be disputed. A sauna is intended for intentional occupancy (unlike, for example, a garage that is entered only to get into a car), but on the other hand, a sauna is generally not suitable for extended stays, especially when pouring water onto the hot stones (Aufguss).

From all my research, a sauna falls into a grey area regarding whether it qualifies as a living space, which has not yet been conclusively determined by the courts.

Yes, a sauna is considered a living space and therefore is not classified as a permitted outbuilding that can be built without setback from the property boundary. You could just as well build a billiard room, a gym, or a home theater. You won’t get approval for that, and if someone files a complaint, it won’t end well.
That said, the fact that such constructions are still regularly built is, of course, a different matter.

Well... that might mean that a garage with a workbench may not be allowed to be built directly on the property boundary (?). How long would one then be allowed to stay in the garage at most? 🙂
A garage party would also be prohibited if the garage is on the property boundary, right? Or does only the primary intended use count?
With a sauna, I would interpret the lounge area as the room that could be designed as a relaxation room.

I see it differently. For me, the main focus would be on relaxation and the sauna experience. In the garden, I personally see enormous advantages of having a sauna. 🙂
