Hello,

I need to create an access road to my building plot. Unfortunately, the property is completely surrounded by a hedge. Since construction is scheduled to start around July, we are still in the breeding and nesting season.

Can I simply cut a 4m (13 feet) wide gap in the hedge to allow trucks access to the property? Does anyone know what the legal regulations are?

This varies depending on the state or municipality. For example, we have fruit trees and hedges on our property, and we are definitely not allowed to touch them unless we have a building permit/planning permission and an approved application from the environmental agency. The environmental agency will approve the application, but unfortunately not before the building permit/planning permission is granted. It also has to be certain that there is no other option.

The application may also require a fee (in our case, €120 per tree).

Do you own the hedge, and is it on your property? Here, the authorities even came out to inspect the property... they are really strict about this!

If you get caught cutting down plants without permission, fines of up to €50,000 may apply 😕

But, as mentioned, it’s best to check with the environmental agency, although it also depends on your neighbors and whether anyone actually cares...

The hedge shouldn’t be so dense that it makes it difficult for the responsible professional to clearly identify that the property is unoccupied. If it is currently being used as a nesting site, then unfortunately you won’t have any luck—at least not in that particular spot.

Lower-level landscape maintenance is typically managed by district authorities. They should be able to tell you what you are (or are not) allowed to do and who is responsible for assessing this. Foresters and arborists are also knowledgeable about these matters. Lay opinions won’t be helpful in this case.
