The plumber accepted the contract and, in the presence of witnesses, stated the work would take two weeks. Now, 14 weeks have passed and only half of the work is completed. Other tasks on the construction site cannot proceed, and the schedules of the other trades are being pushed back. I have now been informed that the work is expected to continue in about five weeks. However, based on experience, I expect this date to be postponed again for some reason. What is the correct legal way to handle this?

Strahleman5 Aug 2021 15:57Maybe VOB §5 can help, especially paragraphs 3 and 4. We are currently experiencing something similar, where our plumbing company is working very slowly (we plan to move next week and the bathrooms are still missing everything). We are now escalating this through our construction company because even our site manager can no longer put pressure on the trades. They all have too much work and leave partially finished sites to go to the places where the loudest complaints come from.

What kind of contract do you have and with whom?
With a general contractor? Directly with them?
There are options – you don’t have to accept that.
Either have the site manager handle it or get the site manager involved.
Reduce the payment to the tradesperson or terminate the contract.
Have you already made any payments? Set a deadline, and do so in writing by registered mail.
