Hello everyone!

I would like to know if it is legally allowed to buy an old house, have it demolished, and then build a new house on the same plot of land. Is it permitted to simply tear down old buildings if they are not protected as historic landmarks?

Another question:
We are considering buying an old house with a large plot together with a couple of friends, having the house demolished, then dividing the land and building two new houses on it. Would something like that be approved? Isn’t that mainly a matter of the zoning plan / building permit?

The reason for these questions is that we definitely do not want to build in a typical new housing development. We want something a bit more private, and properties like old farmsteads or similar seem suitable for that!

Hello Ike,

Whether you are allowed to build two residential buildings on a plot where only one previously stood depends on the applicable development plan (single-family and/or duplex housing). If the plot is large enough, it may also be possible to build two separate houses on two parcels, in case duplex housing is not permitted.

When residential buildings are to be demolished, a demolition permit usually needs to be obtained. The specific state building regulations determine from which building size this permit is required. One reason for this is that the living space of existing apartments and houses in Germany is included in official statistics. Without this, there would be a large amount of living space that exists only on paper.

The application for the demolition permit can be submitted together with the building permit application for the new development. In this case, the documents would state something like: "Demolition of a residential building and construction of a duplex."

However, if the construction project is to be carried out in a rural area (outside of a designated settlement zone), this is extremely difficult or nearly impossible.
