blumingerHello.
There is a lot of information available online on this topic – however, things often change over the years. What is the current situation like, and what would you recommend?
Which contract templates do you recommend? For the Building Code, I am using the one from ZDB, and for VOB, the one from Kohlhammer.
Thank you for sharing your experiences.

Warranty law under the Building Code applies to a wide range of products, whereas the VOB is more specific to construction. However, be cautious with the warranty periods: as far as I know, the Building Code allows for 5 years, while the VOB provides only 2 years. In principle, it might be possible to combine both options (for example, different terms for the foundation and the roof covering), but there are probably very few standard contract templates for this. While this would then be a case for a specialist lawyer, it can be worthwhile in a warranty claim. Hopefully, site supervision will not be carried out by oneself?

The site manager suggests using VOB. The warranty period can also be set to 5 years here.I (although I am not a lawyer) see no issues with VOB except for the possibly shorter warranty period in some cases. If you consider and resolve that, the alternative is clear to me: as mentioned, VOB is definitely more specific, while the Building Code is designed to cover everything that an average person might ever purchase or commission.
With VOB, site managers also generally have more experience: besides the warranty durations, the procedures can differ as well, for example regarding when and how defects must be reported effectively, and when a service is officially considered “accepted.”
