Hello everyone,

We are considering building a house while searching for a property to own. Unfortunately, there is a shortage of available land in the Mainz area. A well-known prefab house company (Bien-Zenker) offered us an interesting plot through a sales representative. As often seems to be the case, we would first have to sign a construction contract before being shown the property. Although there is a cancellation clause stating that if no plot is found within one year, the contract can be terminated, a specialist lawyer advised that this clause is too vague and that we should not sign.

I also don’t like this order of steps. We have already met with the representative and discussed our general ideas and budget, but I would prefer to sign the contract only after soil tests and other surveys are completed, so we can better estimate the costs beforehand.

Now to my question:

Is it now "normal" to sign a contract before even knowing what can be built? Has anyone had experience with adjusting the process order to suit their preferences?

Definitely in connection with a land service.

To a lesser extent, even with your own plot. Here you get a rough cost estimate, but additional costs due to difficult soil conditions, information on other ancillary building costs, or scaling up are still missing.

At the moment, it’s a take it or leave it situation. That means you either accept it or the deal will be made with someone else!

Good lawyer. He basically answered your question himself. I wouldn’t agree to such a contract arrangement. There are always better ways or options to find a plot of land, even if it sometimes seems hopeless.

That doesn’t mean everything will go smoothly, though. But you become completely dependent if you want to avoid a contractual penalty.

There are actually sales representatives who offer both land and house and still initially inform you about the exact plot of land, but this seems to be increasingly rare, especially with major providers like Bien-Zenker, DFH, and others. I wouldn’t recommend it unless you want to build with that company for some specific reason. If you only ended up there reluctantly because no other plots are available, it’s better to avoid it.
