ᐅ Neighbor’s garage roof above my insulation

Hello, my neighbor is renewing his garage roof. The garage is attached to my house wall. The wall above it was insulated up to the (old) garage roof. Now it looks like he will raise the roof higher than before, so the wall edge will be above the new opening where his roof used to be.

Besides wondering whether he is even allowed to raise the roof (even if it is only 10–20cm (4–8 inches)), I am also concerned whether the insulation gap (about 20cm (8 inches)) that will be created might cause a thermal bridge. This gap would be inside the garage.

Unfortunately, I do not get along with my neighbor, otherwise I would have asked him what he plans to do.

Building permit? Sounds annoying, but you need one if the garage’s height is increased. You are allowed to replace or repair the insulation—just look up “Hammerschlagsrecht” online; the neighbor must let you enter their property for this purpose.

You might also want to check the original building documents to see how the attached garage is regulated. If your neighbor now wants to increase its height, you might have grounds to refuse.

Thank you! I don’t have any building documents describing something like this. So far, he has always built his sheds and balconies without a building permit or planning permission, so I can’t imagine it’s different this time. There should also be a notice with a red dot posted outside, right? But there isn’t anything there. The garage is also being expanded on his side, making it wider. He will definitely need a permit for that.

I just don’t want to end up with mold or water damage later because he did the wall sealing incorrectly. Does anyone know the regulations for how this should be done?

I hate situations like this, I really don’t want any trouble…

You do have the right to access the building file; it is kept at the building authority.

Where exactly is your insulation located?

On your property or theirs?
