Hello,

the BG Bau wants to know something again.

Among other things:

"Who has provided the construction financing and in what manner?"
or
"Who has signed loan agreements with which bank (please attach copies of the credit agreements)"

I am now wondering if I am even required to provide this information.
The letter states:

"
Due to the obligation to provide information, we refer to §§ 191, 192 of the Social Code (SGB) VII in conjunction with the statute of BG BAU.
"

I have looked up these references and consider only the following paragraph to be relevant:

"
(5) Property owners are obliged, upon request of the responsible accident insurance provider, to provide information necessary to fulfill the statutory duties of the accident insurance provider (§ 199). This includes
1. information on whether and which non-commercial construction work is being carried out,
2. information on which contractors are commissioned to perform commercial construction work.
"

From this, I conclude that I am not obliged to provide any information about our financing.

Am I misunderstanding this? How was it for you?

I find that at least unusual. Here, they also wanted to know quite a lot, but mainly details like “Which trade was completed by which company,” “Where were own contributions made,” and “What was accomplished within which timeframe with the help of construction assistants.”

If in doubt, just call the provided phone number and ask what this is about and what difference it makes for the accident insurance (BG) whether the house was paid for from own funds or with bank financing.

The only thing I could guess as a layperson is that they might be unclear about who the owner is and who the client (builder) is, and therefore who falls under the insurance obligation or perhaps does not. However, this could have been phrased more clearly.

I would be interested to see what the reply is.

I would be interested as well.

We had the same questions as @toxicmolotow – and these have been asked several times before. Since we are contracting each trade separately, we can only provide information step by step.

One might assume that if 100% external financing is used, there would be no deliberate undeclared work on the construction site, since every dollar must be accounted for to the lender with proof of expenditure. Accordingly, homeowners using their own equity and/or providing their own labor might be more likely to be suspected.
But this is just my attempt to find some sense in this strange line of questioning. If I were correct, I would find this way of asking quite questionable.

We probably received the same letter. Only he is listed on the building permit / planning permission and in the land registry. Still, I consider myself a builder as well since we make every decision together and pay for everything together – even though only he applied for the loan (due to the land registry; I’m not foolish enough to sign if I won’t own anything later). So I included myself as a builder on the first form – I suspect that’s why the second form arrived and the building regulations office wants confirmation from me as soon as I take any action on the construction site.

Is it similar for you?
By the way, I couldn’t understand on what basis they want to see our loan agreement. We didn’t send it to them and are now waiting to see what happens.

No, we do not have such a situation.

I will first submit the form with the information that we are obtaining loans from Bank X but without specifying any amounts. They should get back to us later.
