Hello,
the BG Bau wants to know something again.
Among other things:
"Who has provided the construction financing and in what manner?"
or
"Who has signed loan agreements with which bank (please attach copies of the credit agreements)"
I am now wondering if I am even required to provide this information.
The letter states:
"
Due to the obligation to provide information, we refer to §§ 191, 192 of the Social Code (SGB) VII in conjunction with the statute of BG BAU.
"
I have looked up these references and consider only the following paragraph to be relevant:
"
(5) Property owners are obliged, upon request of the responsible accident insurance provider, to provide information necessary to fulfill the statutory duties of the accident insurance provider (§ 199). This includes
1. information on whether and which non-commercial construction work is being carried out,
2. information on which contractors are commissioned to perform commercial construction work.
"
From this, I conclude that I am not obliged to provide any information about our financing.
Am I misunderstanding this? How was it for you?

Is that really the case? The BG Bau itself excludes spouses and partners from its insurance coverage.

There is the option to insure yourself voluntarily. In that case, BG Bau does not cover spouses or partners. So why does it matter whether someone is the client or “just” the spouse? They are not insured anyway...
Therefore, BG Bau really doesn’t care whether someone is officially registered or not.

They also wanted a lot from us. It ended up in the trash. After the build, another letter arrived. I sent them the list of trades from the contractor (instead of filling out every line on their form) with the note “no own contributions” underneath and emailed them that they could forget the rest. Nothing came after that...
bg Bau (building cost declaration) has less to do with illegal construction and more with how much you actually do yourself. They want money for the work you did yourself. When you build with a construction company like we did, all the trades are predefined by the company. We got through the bg Bau easily then.
One might think that those using 100% external financing would not knowingly have any undeclared work on the construction, since every dollar must be documented for the lender. Accordingly, homeowners using their own funds and/or performing their own work would be more suspicious. But this is just my attempt to find some sense in this strange question. If I were right, this line of questioning would seem very questionable to me.
