ᐅ Main Water Line Running Through Our Garden – Is Building Over It Allowed?

Hello everyone,

the main water supply line for our neighborhood runs right through our garden, even though the municipality does not have an easement for it. I have tried to resolve this issue with the local authorities, but I was not offered any reasonable solution.

Am I allowed to plant a tree over the pipeline or build a garden shed on top of it? Does anyone have any experience with this?

If you know the location of the pipe and plant a tree exactly there, you could be considered negligent, and it may be attempted to hold you responsible for any costs arising from damages.

Did you already know this before buying?
Of course, you don’t plant anything on top of it; I wouldn’t want to deal with the foreseeable legal dispute.

The power line runs straight across our garden. Because of that, I can’t plant any trees, especially since there are also high-voltage cables along the property boundary. The land has belonged to our family for decades; apparently, my grandfather had an informal agreement with the local authority.

However, we are now facing some problems and receive very little support from the local authority. Honestly, I’m getting tired of accepting everything, especially since over the past decades we have already contributed a lot to the community.

Many regulations, as well as special laws such as §93 of the WHG, establish obligations to tolerate on behalf of utility providers, without the need for registering a right of way or easement. Have you already checked?
