Hello everyone,
We recently moved into a newly built house equipped with a ventilation system from Zehnder. The problem is that the wastewater vent pipe is located right next to the supply and exhaust air ducts of the ventilation system on the roof, which occasionally causes a very unpleasant smell inside the house.
Does anyone have experience with this? How was it resolved? Would this be considered a construction defect (from a legal standpoint)?
Attached is a picture of the roof situation. Maybe someone has a simple solution for this.

When working with a developer, the construction contract with the client is very important, even the most important document. Read it carefully to understand what is included; if there is too much technical jargon, consult a lawyer to check whether there are more detailed clauses addressing the issues.

Hello again. After a long back and forth and a deadline set to resolve the issue, unfortunately, nothing has happened so far on the part of the builder. I am now forced to take care of it myself.
Could someone here in the forum recommend a company in Berlin that can solve this problem for me? I believe it’s only about routing the pipes on the roof and not inside the building.

Also, the deadline should be set for the date of the inspection of the defect, not for the correction itself. Everything should be reasonable.

Also, you set a deadline for an inspection of the defect, not for the repair. Everything should be proportionate.According to our lawyer, the next step is to find a company that can fix the defect and obtain a cost estimate from them. We will then set a deadline with our builder for the repair. If there is still no response, we can have the work done ourselves and withhold the corresponding costs from our final purchase payment for the time being.
And that is exactly why I am now looking for a suitable company in Berlin.
PS: An inspection of the defect is no longer necessary. The builder has already acknowledged the defect.
