Hello,
the BG Bau wants to know something again.
Among other things:
"Who has provided the construction financing and in what manner?"
or
"Who has signed loan agreements with which bank (please attach copies of the credit agreements)"
I am now wondering if I am even required to provide this information.
The letter states:
"
Due to the obligation to provide information, we refer to §§ 191, 192 of the Social Code (SGB) VII in conjunction with the statute of BG BAU.
"
I have looked up these references and consider only the following paragraph to be relevant:
"
(5) Property owners are obliged, upon request of the responsible accident insurance provider, to provide information necessary to fulfill the statutory duties of the accident insurance provider (§ 199). This includes
1. information on whether and which non-commercial construction work is being carried out,
2. information on which contractors are commissioned to perform commercial construction work.
"
From this, I conclude that I am not obliged to provide any information about our financing.
Am I misunderstanding this? How was it for you?
Best regards

This has already been asked several times. Since we hire each trade separately ourselves, we can only provide information in parts.Yes, I also filled out the form 3 or 4 times, which was easy enough, but each time I only listed the newly appointed contractors. After a while, it just became frustrating.
I’m also curious about the purpose behind this question, because, primarily, I would say: This is none of your business, since the source of funds for the construction itself is irrelevant.
One has to admit this about the building regulations: they are fast. Today, after only 3 days, they already requested a copy of the construction financing showing that I am also listed – to recognize me as the builder.
Let’s see what the phone inquiry about this nonsense will bring; they should be able to figure out themselves that, as I’m not the property owner, I wouldn’t sign the loan agreement. And if we submit our private contract to them, I will definitely black out the figures – after all, the amounts are none of their business.

The client is the person who is legally and financially responsible for a construction project or who acts on behalf of another party. Neither applies to you, even if you feel differently. Therefore, the confusion from an outside perspective is understandable and has nothing to do with your counterpart "thinking ahead."
That is correct. You are not listed in the land register and are not part of the loan agreement. Therefore, you are not the legal builder (owner) in the official sense.
As a result, you need to have appropriate insurance for any construction-related activities.

If he/she awards the contracts as the client, he/she is financially responsible. Where the money comes from is a separate matter.
