KrolockHello, following up on the first post about the smelly roof insulation – the roofer is insolvent. However, it wasn’t our fault; apparently, there were issues with a large project.
Inspections and statements from the insulation manufacturer’s sales department confirmed that the work was carried out correctly, but the roof insulation smells like cat urine when it is cut. According to the manufacturer, this should fade over time, but since it hasn’t, am I correct in assuming that the manufacturer is liable to us for the product?

You will never get a simple yes or no answer to a question like this. There are several conditions that must be met to make a claim under product liability law. Since, in this case, there appears to be no harm to life or health (at least not yet), the next step would be to determine whether damage has occurred that could not be caused by the product itself. Apparently, that is not the case here either. Based on the information provided, liability under product liability law can therefore be excluded due to the absence of a relevant legal basis.
