Hello dear community,

we are purchasing a plot for a semi-detached house, and the notary appointment is already scheduled. The large plot will be divided 1:1 through a real division; the survey has already been requested by the seller. The other half remains the property of the seller and will then be developed together with one semi-detached house each. We are all in agreement on this. The seller has submitted a preliminary building inquiry with an architect, and the response was that the project will most likely be rejected because a building alignment (building line) does not fit. Everything is being built according to §34. The original large plot is perfectly rectangular—so very suitable for a 1:1 division.

For these reasons, the notarized purchase contract will regulate that the real division will only be carried out later, depending on the necessary adjustments to the building placement/building envelope on the plot (measured precisely down to the centimeter), but basically still a 1:1 division. It would be inconvenient to fix a survey with boundary stones before, only to have to adjust 5–10 cm (2–4 inches) later.

Furthermore, the sequence then changes: after notarization, after the construction cost estimate and financing commitment, we will sign the construction contract with a general contractor. Only after that will the builder prepare the building application. Does it matter for the builder or the municipality that the building mass is initially planned on a plot that has not yet been precisely surveyed (as if it were, for example, a condominium property)? Or is this not possible, and you must first submit an official preliminary building inquiry, then have the plot surveyed after approval, and only afterwards submit a formal building application?

What is the best way to plan all this?
