Hello,

if the process with a home builder is handled through an independent brokerage agency, does that have advantages or disadvantages for me?
What does that mean exactly, and are there any alternatives at all?

I simply don’t understand it. Company xy sells houses, let’s say, throughout northern Germany. The sales are handled by representatives, most likely working on commission. You receive an offer from the representative. It seems acceptable to you. You might even sign the contract with the representative, or perhaps they are authorized to sign on behalf of the company; otherwise, someone with power of attorney from the company signs it.

Where exactly is the problem, apart from the fact that you are, of course, also paying their commission? After all, they negotiated with you for that. Karsten

... then I first have to guess what you actually mean with that question: Is this the first time you have encountered a sales representative from the home provider whose business card clearly shows that they are not an employee?

In sales (in almost all industries), it is very common to work with commercial agents. These are people who do not have an employment contract with the company they represent but work based on a commission agreement.

Terms like "independent sales partner / agent / broker / representative" essentially mean: "this person is not directly part of us," which usually indicates that they do not have authorization to act on behalf of the company.

The contracts they present (including any cancellation policies, etc.) clearly state who the actual contractual party is. Usually, these contracts must be confirmed by that party first.

Because such agents lack full authority, side agreements signed only by them are usually of little value. If the content of these agreements is missing later from the order confirmation of the actual contractual partner, you may need to cancel.

Reputable providers do indeed use independent commercial agents—sometimes these agents exclusively represent just one company in their sector, but that does not change their status.

Ultimately, it does not matter to you whether the sales agent receives holiday or Christmas pay or a fixed salary during illness. What their word is worth to you depends solely on their status. Only managing directors, authorized officers, and agents with power of attorney can commit the company legally. Parents can sign for their children, but teddy bears cannot :-)

The home provider is the one building your house, not the sales agent. The contracts and terms and conditions usually also state that the "independent ..." agent is not allowed to accept payments, and so forth.
