Hello,
If a roof terrace in a condominium has defects, does it count as individual or common property?
If this roof terrace also serves as the ceiling of the apartment below, how is the ownership classified then?

Normally, a standard ceiling is considered individual property. But in this combined case of a roof terrace that is also the ceiling of the apartment below?
Could someone please clarify this for me?

For relatives (apartment owners):
Balconies/loggias are part of the common property, with exclusive usage rights since they belong to the apartment.
Non-visible parts may be improved, for example with tiles, but the waterproofing underneath is the responsibility of the community.

The rest is... just guesswork without the declaration of division. There’s nothing written there, the property manager knows but can’t do anything, but anyone without expert knowledge can tell that for sure, the forum might guess it, no, that doesn’t convince me. You have to approach this much more thoroughly and carefully if it’s going to work out well.
