Hello!

I’m new here and would like to introduce myself briefly. My name is Murat, I live in Kiel, and I don’t have much knowledge about real estate, which is why I’m now bothering you all ;-). I just hope my question is in the right place here, since the forum seems to focus more on house building than house buying...

Specifically, it’s about the following: I want to buy a three-family house that was built in different phases. The original building is a semi-detached house from the 1930s, then in 1959 an extension was added, creating another dwelling. In 1972 there was another addition, where the 1959 and 1972 sections were combined. This means that between the “new” and the “middle” part, an opening was made on both floors, so there is now a flat on the ground floor that also includes the middle section. On the upper floor, the apartment similarly extends over the “new” and the middle parts. This may be a little hard to understand based on my description, but it shouldn’t be too important for the question.

In any case, the partition declaration (property division document) was not updated after the new construction. What I’m missing now are the exact details of the living areas. Is the real estate agent obliged to provide me with a precise living space calculation? I only have a few building plans, from which some measurements can be taken, but not all that would be needed for an area calculation...

No, a real estate agent acts as an intermediary – how precise that is depends on them. Most rely on the data and facts provided by the seller. If you find the information unclear, you can ask the agent for more details, but they are not obligated to provide them (except for the duty to be truthful). Especially when multiple interests are involved, it is difficult to encourage the agent to carry out measuring and investigative work.
