we are planning to purchase an end-terrace house that is currently under construction. However, we are now quite uncertain because the exterior landscaping plan proposes that almost the entire garden area is to be designed as an infiltration zone (see attachment).
We are trying to influence changes, as are other owners, but if the drainage design remains the same, I would like to know the following:
Is it allowed to build over or cover infiltration swales?
This would hopefully allow us to make use of the area rather than losing it entirely, for example by installing a swing or something similar.
Under whatever type of cover that might be used, there would be 15 cm (6 inches) of airspace between the bottom of the swale and the cover. This is certainly not ideal or desirable, but I would like to know if it is even permitted.
I am only familiar with swales being open, probably because they are usually placed in unused areas. In our case, however, the requirements for drinking water protection (protected area) and the space needed for that conflict obviously with the available space on site. Great planning, then.
So, does anyone know whether it is possible or allowed to build over a swale? What might need to be considered?

Generally not, and minimum distances must be observed... but whether something like a swing set counts as building over is another question.
Every state, municipality, and thus every environmental authority has different regulations. Contact the "Senate Department for Urban Development and the Environment." That’s their purpose, and they can specifically answer your questions. You could have easily found this out yourself with just a few clicks, as I did...
