Dear forum members,

We received the wrong kitchen appliance. The desired model is better and more expensive (and was paid for accordingly!). Instead, we got something much worse. We have filed a complaint. The retailer replied once to our email but has not responded to any further messages since. This has been going on for two months now. How should we proceed? Looking forward to good advice.

Best regards, Steffi33

Does the seller have a proper imprint with an address in Germany? How long ago was it published? (Just some facts, please…)

I would announce the return by registered mail with a notification in the mailbox and request the delivery of the correct device within a 14-day period (so, formally demand it). If nothing happens after this deadline, try doing the same with a letter on a lawyer’s letterhead (maybe you know someone, otherwise you have to pay).

What is the value of the dispute?

In parallel: use review platforms. That can sometimes help as well ;-).

After the deadline, I would withdraw from the contract and refund the money. Then he will come to pick it up.

Here is some feedback from me on this topic... I paid via PayPal, which offers buyer protection. This protection lasts for 150 days from the payment date. It can be a bit complicated, and you have to be very careful with deadlines once you start the process! First, a mediation attempt is made. During this attempt, I properly returned the wrong item unused. Unfortunately, the seller still refused to refund the money. Now, PayPal has stepped in and refunded my payment. That’s what I call excellent service! I definitely wouldn’t have managed this on my own! 🙂 Best regards, Steffi33.

Great! PayPal is clearly not a lawyer’s favorite 🙂

Considering the fees Paypal charges for each transaction, that is perfectly reasonable.

It works just as well with a reliable credit card.

And it doesn’t mean that the matter is over...
