ᐅ Proof of insertion: what exactly serves as valid evidence?

Hello everyone,

Here’s the situation: I plan to build a garage on our property, but with the special condition that it will be only two meters (6.5 feet) away from the sidewalk instead of the four meters (13 feet) required by the local development plan. For this, an exception permit is necessary. I had a plan drawn up and submitted through an architect known to my father (older generation), so far so good.

Now, I received a letter from the building authority requesting a "proof of integration according to §34 of the Building Code" in duplicate, showing that similar built garage areas exist within a radius of 100 meters (330 feet). I found two suitable examples in the area. However, the question is how to provide this proof. The architect consulted his references and is unsure; he suggested sending the building official images from Google Maps or photos along with the addresses of the properties. But this doesn’t seem like the proper official procedure. Unfortunately, I haven’t been able to reach anyone at the building authority either last week or today...

Since time is running out and my application will otherwise expire, I thought I would ask here if anyone has had to provide such proof before in this form.

If the properties are too far away, that’s not neighbor construction—just a heads-up.

So, I measured the distance to the houses using Google Maps’ “measure distance” tool, and I measured the distance from the garages to the sidewalk with a laser distance meter.

Okay, then I will attach screenshots from Google and see if I can find anything on the cadastral map or Boris Hessen, which I discovered as well.

Ah, cool. As someone who usually uses a tape measure, I hadn’t thought of that. By distance, I actually meant: if your house number is 1 and your example is house number 18, then you might no longer be able to refer to it as neighboring development after 34.

Okay, yes, they specifically stated in the application that it must be within 100m (330 feet). Some of the buildings I found are directly in sight, while others are a bit farther away. But you can easily measure that using Google Maps.

Thanks for the input, I’m submitting everything today and hope it works out. Germany and its bureaucracy 🙄
