Hello, we had our house renovated to meet the KfW Efficiency House standard and need to provide a blower door test result of a maximum value of 3 for the final certificate. During the test, we recorded a value of 10!! All the leaks were located at the roof. The roofer sent his team: the roofing membrane was almost completely not sealed. They supposedly corrected this defect. The next test was scheduled - the result was still 5. The roofer was present during the test and carefully inspected the remaining leaks. However, some of the drywall installed on the first floor now needs to be partially removed for this. The roofer agrees to carry out the roof work, but says the drywall contractor is responsible for the costs of the drywall work. According to him, under the VOB (German construction contract procedures), as the subsequent trade, the roofer should have been notified about the improper execution of his work before the drywall was installed. According to the Chamber of Crafts (arbitration board) – which matches my opinion as well – the drywall contractor is not the authority responsible for inspecting the roofer’s work. The roofer has not yet provided relevant excerpts from the VOB (he claims to have emailed them, but strangely, they have not been received here).
Can someone provide insight on this? In my opinion, the roofer must properly rectify his work and also cover the follow-up costs for removing and reinstalling the drywall, including wallpapering.

Sorry, but I don’t see it as clearly as the conciliator does. Who was in charge of supervision during the refurbishment of the single-family house?

We had an architect who did not fully meet his obligations. That means he did not respond to our request to complete a form needed to apply for the subsidy for additional construction costs (sent several times by email and twice by postal registered mail). He also rarely showed up during the construction work.

In my opinion, he is partly to blame. For advice on this, consult a lawyer specializing in construction law and contract law. By the way, I think the roofer is right in saying that the preceding contractor is obliged to point out any mistakes to him.
