Hello,
I am new here and haven’t been able to find anything through the forum search. I hope someone can help me with the following issue:
I bought a house from Helma, or rather had a new one built. Apart from a few exceptions, I’ve been relatively satisfied so far. However, the final handover is now scheduled, even though the photovoltaic system is not yet connected and the battery storage has not been delivered. The site manager also couldn’t give me a completion date. Since I have already terminated my current rental, I definitely need to move out this month.
What should I do now? Should I postpone the handover indefinitely until everything is installed? Should I go ahead with the handover and document all defects? And how should Helma compensate me (since I cannot use the photovoltaic system and battery storage yet, resulting in significantly higher electricity costs)?
Is there anyone here with experience in this?
I look forward to your help.....

Stefan0015 Sep 2022 21:04Have you received a cost-effectiveness calculation from Helma? It should include the expected yield for the year, or even for the month, as well as your planned self-consumption rate. With this information and your current electricity price, you should be able to calculate compensation. This would allow you to negotiate with Helma.

WilderSueden5 Sep 2022 22:53I would definitely move in, but with acceptance subject to the missing system and a corresponding retention. Once it is installed at some point, the remaining payment will be made. You can of course consider claiming damages, but the question is how much you will actually receive. However, if goodwill has already been shown, it is definitely worth trying.

@Snowy36: Yes, you do have a claim for damages. I also know people who were reimbursed for the rental costs of a replacement vehicle in exactly this situation. They had a fixed commitment with a delivery date. If you booked a vacation based on this assurance and then need a replacement vehicle, in my opinion, you are also entitled to compensation—unless it is explicitly excluded in your contract. The contract states the delivery date is approximate.
Now the question is what the contract between the original poster and their builder says.

...Thanks for the note. No, not yet. I will follow up with Helma regarding this...J

Yes, that is already arranged. The final installment is transferred half to a notary escrow account and will only be paid out to Helma after I have given my approval.

HilfeHilfe6 Sep 2022 06:15Have you ever asked Helma what kind of compensation you can expect?
As mentioned, you also have expenses for electricity and heating in your old apartment. These costs need to be taken into account as well.
Perhaps Helma has some experience or reference values.
