ᐅ Paving Work – What Warranty or Guarantee Am I Entitled To?

Hello everyone,

We have now been living in our new build (semi-detached house) since December and had the paving installed by the developer in anthracite color with 20x20 cm (8x8 inch) stones.

At the time of signing the contract, the developer was still working with a well-known company, but due to cost reasons, they parted ways with the paving contractor and hired an alternative, unknown company to lay our paving. At first, this was fine with us since we just wanted it to look neat, regardless of who installed it.

However, we are now experiencing significant problems with the paving.

When the snow melted shortly after we moved in, we noticed that the patio paving had already settled after 4 weeks. We reported this, and the patio stones were removed, the base was re-prepared, and the paving was reinstalled.

Two weeks later, we noticed settlement and lifting in the paving in front of and beside the house. We also found isolated cement/concrete stains on the entire paved area that could not be removed. Along the entire length of the garage, the first row of stones is heavily scratched, causing damage to the stones.

The paving contractors came back; we showed them all the defects, and while they fixed some of the issues during our absence, not everything was addressed.

That was 3 weeks ago, and the newly laid section has already settled again in one spot. The problem is that some stones have been replaced, and these are still much darker than the others. The overall appearance has become quite poor.

I have reported this again to the developer (third complaint). He said he would send his employee to mark everything, then replace stones and partially re-lay the paving. I already fear this will make the appearance worse than it is now. The issue is that the original offer mentioned that with anthracite-colored stones, color differences or efflorescence might occur. This did happen, but the contrast between the new and old paving was hardly noticeable in comparison.

My question to you is: Does anyone know if I have to accept this patchwork and the strong color differences, or (and from when) do I have the right to demand a complete replacement of the paving, possibly insisting on the previously well-known reputable company doing the work?

Both compact and leave as is.

Backfilled in December 2017 and will be paved in spring 2019. Unevenness is slowly appearing, although it was well compacted. However, we filled about 120 cm (47 inches) in front of the garage.

That is quite a lot. Layered filling and compaction is probably the only way to go. However, soil can be quite unpredictable at times...

Was the ground really compacted thoroughly, not just with a vibrating plate, but it can still settle by up to 5 cm (2 inches) in height.

An uneven surface is frustrating forever, and we use the garage whether it is paved or not.
