We are currently planning a new build in Schleswig Holstein.
Since the orientation of the house is not suitable for a solar system, we would prefer to leave it out. We are planning a KFW-70 house (gas condensing boiler, ventilation system with heat recovery, various insulation measures for the floor slab, walls, roof, triple glazing).
Is it possible to comply with the Renewable Energy Heat Act without a solar system?

Hello,
According to the Renewable Energy Heat Act, a certain proportion of renewable energy must be used. However, it is possible to implement alternative measures instead.
With these alternative measures (for example, improved insulation, ventilation systems with heat recovery, etc.), the annual primary energy demand and the heat transmission loss (both requirement values of the Energy Saving Regulation) must be reduced by at least 15%.
These conditions are met with a KfW 70 house.

You will not get an exemption because you have already installed the wrong heating system!
I had the same problem in 2010, with a gas boiler and a ventilation system.
There is no way to save energy with solar thermal when using a gas boiler!
It has not been allowed since the 2009 Energy Saving Ordinance.

However, in that case, you will need to use a heating system powered by pellets, wood chips, or firewood.
These renewable energy sources are carbon-neutral, allowing you to comply without solar.
Otherwise, you will not receive a building permit / planning permission.
I personally experienced this energy saving regulation law last year.
I have a gas boiler and ventilation system, and I HAD to install solar panels on the roof.
