ᐅ Mold on wood/structural frame—Is it possible to withhold payment from the progress invoice?

Hello,

our shell construction has been completed since December, and the windows are currently covered only with protective film.
Since we have a flat roof, there is the possibility to convert the attic later on.
Therefore, the ceiling above the staircase was closed off with a wooden structure.
The vapor barrier and the flat roof have been completed.

No interior walls and nothing plastered yet. For 2 months, there was still water standing in the basement up to 5cm (2 inches).
Because the windows are covered with film, there was heavy condensation inside during December and January.
Now I have noticed that mold spores are appearing around the roof hatch.
Just yesterday, the second interim invoice arrived, which should be paid within the next 10 days.
That’s 150,000 euros. The first payment was 140,000 euros (there are 7 in total).

Can I deduct something from the invoice amount and demand that the defect be fixed before I pay?
We are building a turnkey house.
Should I get an independent expert to assess the situation?
What do you think?

In my neighbor’s semi-detached house, the mold infestation is even worse...

Regarding heat – it is currently 6°C (43°F) here, so we are far from any heat in this area 😉

I would always recommend hiring an expert surveyor. When you are investing 460,000 euros, the cost of a surveyor is not significant anymore. Now, regarding withholding payment: if you want to retain money, you should first issue a formal notice of defects. The defect should be documented as precisely as possible. Having a surveyor is very helpful and advisable in this process. Photos alone are usually not sufficient as evidence in case of a dispute later on.

Your house is like a pot of water for cooking spaghetti: "the water boils and the lid is on."

As we all know, mold requires certain conditions to thrive.
It does not grow below +10°C (50°F) and feels comfortable at a relative humidity of 65% to 85%.
Below 65% relative humidity, mold growth is not possible!

There are two factors relevant to mold growth:

  • Sufficient moisture availability
  • Presence of materials containing organic components (e.g., wood)

Mold can only grow on materials that have elevated moisture levels.
Moisture can come from water intrusion or
condensation forming on cold exterior wall areas.
The uninsulated wooden cover/attic hatch above the stairwell is where condensation forms, and it is made of organic materials.

So now,
the building expert currently measures +6°C (43°F) here, I have +7.3°C (45°F) with 63% relative humidity.
Is your heating switched on, or why do you have mold? 😕

I received a response today that it is just mold spots and they will be removed in the next few days.
The heating is not on yet because none has been installed so far.
So everything seems to be harmless...
