Have you already formally complained about the defect in writing and requested its correction in writing? If your contractual partner is not cooperative, I would recommend seeking legal advice without delay.
Very important: You are not responsible for proposing solutions. That is the responsibility of your contractual partner. They should explain how they intend to achieve the required condition. And don’t accept weak compromises without careful consideration…
I honestly can't imagine that the site manager or tradespeople really made a mistake there. I mean, it’s a professional company! They know what they’re doing. It’s not like they were hired through MyHammer or eBay...
And if they did, be careful with the complaint process. Make sure to meet all deadlines and formal requirements. Otherwise, it won’t work out. And yes, don’t settle for a weak compromise!
