I plan to build a house next year. I have already found a suitable plot of land and obtained the necessary site assessments.
The only issue is that a power line runs directly over the planned building area (these are "small" utility poles supplying a local neighborhood). Before submitting the documents, I conducted an on-site inspection with an employee of the utility company to generally find out what would be possible regarding this power line – it must be relocated to maintain a minimum distance of 3 meters (10 feet). The employee also mentioned that there is a fairly good chance that a hardship clause might apply in this case, meaning that the relocation costs would have to be covered by the utility company.
After receiving the official site assessment from the utility provider, it stated the 3-meter (10-foot) distance requirement and informed me that the relocation must be carried out by the applicant (and probably paid for by them).
Who has experience with this hardship clause, and what are the criteria for it to apply? Thank you.
