ᐅ Land Surveying: Who Pays for What?

Hello everyone,

I urgently need your help. I own one half of a semi-detached house. Previously, a single family lived in both halves, and I have been paying my property tax and everything as usual. However, now there is a new wastewater regulation. Since I received the bill for the entire property (both halves) from the city, I went to the city office. They told me that the property is divided proportionally but hasn't been surveyed to determine the exact area of each half. Now I am receiving the bill and would have to calculate with my neighbor how much each of us has to pay. The woman said it is also possible to have a survey done, but this involves costs.

Long story short:
If I decide to have the property surveyed now, who is responsible for covering the cost? All owners of the properties adjoining mine? Or only the person who initiated the survey?

Hello Spale,

first of all, a general note:
The costs for the surveyor must be paid by whoever hires them.

Regarding your specific case:
I would strongly recommend discussing this with your neighbor. With the current bill, you’ll need to find some agreement between you, but after that, I would have the properties surveyed as soon as possible!
Do you have a good relationship with your neighbor?
Then you should be able to agree on the costs of the survey as well.

In my opinion, the problem is this: even if you get along well with your neighbor now, that doesn’t mean it will always be that way. Or your neighbor may need or want to move for work reasons (private reasons, …, …) — you don’t know who the new neighbor will be or if you will get along with them!

I am firmly of the opinion that: no matter how well you get along with your neighbors — everything must be clearly and legally separated and arranged — then the chances are best that you will continue to get along well! 😀
