ᐅ Is it Permissible to Use a Construction Site Camera for Monitoring?

Hello everyone.

Has anyone installed an automatic camera for monitoring their construction site during the building process? Or to later create a time-lapse video from it? Is this allowed? Of course, I only want to photograph my own property, not neighboring properties or streets, etc.

Some time ago, I read something related to this topic, but I cannot recall the source now. Although it was specifically about cameras on buildings, I imagine it could also apply to private construction sites. The discussion focused on personal rights and, at the same time, addressed the interest in surveillance.

Regarding personal rights, the issue is that observation can constitute a violation of these rights.

Concerning the interest in surveillance, the key point was to assess to what extent surveillance is strictly necessary and for what purpose.

In your case, I would therefore suspect that your project might not be permissible.

I don’t even need to look at the link from @Bauexperte because I already know that such warnings always get ignored in these threads when male homeowners are excited to document their house construction with technology.

I’ve posted about this before and mentioned the right to one’s own image – but that is usually overlooked and only becomes relevant again when their own boss wants to film them every day.

However, these time-lapse videos hardly show the faces of the workers, meaning they cannot be recognized, especially when there is a considerable distance between the property and the camera. But they still need to be informed about it.

You should also ask yourself the counterquestion: would I, as someone working there, want to be filmed? Even if you are unsure whether you could theoretically be recorded, it might still be prohibited. At least, there was a court ruling in favor of an employee.

But now you are comparing apples and oranges.

There is a difference between an employer filming employees for monitoring purposes, which implies mistrust or accusations, and a homeowner filming their house construction out of personal interest without suspicion, where the workers happen to be in the footage because there is no other way.

Nonetheless, the worker still has their personal rights.
