Hello everyone,

Here is the situation:
Shortly before completing our house, it was discovered that the wastewater pipe coming from the foundation slab was installed too low, and the slope toward the sewer connection is insufficient. We reported this issue and requested a correction. The defect was noted in the acceptance report and has since been resolved.

Now, the construction company is asking us to cover the costs because the wastewater inspection chamber was not in place before the foundation slab was built, so the reference point was missing. However, we were never informed about this. In my opinion, the sewer connection could also have served as a reference point. We were also never warned about the possibility of having to bear these costs ourselves.
What are your thoughts on this matter?

Is the slope insufficient because the water does not flow, or because the connection point cannot be reached with an otherwise appropriate slope?
Who planned the wastewater system, and what was actually installed? Etc.

So, based on your posts, either you or the contractor is correct. You need to clarify your situation and provide more detailed information.

We built with a general contractor.
All plans were created and executed by the construction company (or by subcontractors). During the planning phase, we only obtained and forwarded the municipality’s documents regarding the location of the sewer connection.

In January 2020, the initial meeting took place on the site. The general contractor, the architect (provided by the general contractor), and a representative from the company responsible for the foundation slab were present. The missing inspection chamber was not discussed at this time.

In April 2020, the foundation slab was poured.

In June 2020, the sewer pipe was to be connected. It became apparent that the slope was insufficient.
We reported this as a defect. The work was carried out on site by a specialist company.
The sewer pipe runs a total length of 15 meters (49 feet). Before correction, the slope was 6cm (2.4 inches) from the house to the sewer connection.
Therefore, the sewer connection was not made with the proper slope of 1cm (0.4 inches) per meter.

The handover took place in mid-August. We made sure the defect was documented.

At the end of August, the sewer pipe leading from the foundation slab was raised by 10cm (4 inches).

At no time were we informed that there was a risk of additional costs for us.

So you hired the company for the wastewater pipe yourself, not the general contractor?

And now this company wants to be paid for the repair work?

No, sorry that I expressed myself unclearly.
The wastewater pipe coming from the foundation slab and passing through the frost protection layer had to be raised.
We are now being charged for this work.

And who installed the pipe? And who hired this company?
If it came from the general contractor (GC), I would simply refer that matter to the GC so they can sort it out. Basically, you are probably the innocent party here (although being right and getting legal recognition are two different things), but the question remains: who was the client for this work and the company involved?
